These Terms of Use (“TOU”) for promotional codes set forth the agreement between:
• ASMODEE GROUP (“Asmodee Group”), a simplified joint stock company with a single shareholder and capital of 60,444,400 euros; registered in France at RCS de Versailles under company number 399 899 806 and domiciled at 18 rue Jacqueline Auriol, Quartier Villaroy, 75280 Guyancourt, France; acting in the name or on behalf of all the studios in the Asmodee Group that publish on Unboxnow.com.
• Any person (“User”) legally authorized to accept the terms of website registration on www.unboxnow.com (“Website”), the AsmoConnect network, and Board Game Arena website (“BGA”), and who has in their possession at least one single-use promo code (“Promo Code”) gained by purchasing an Asmodee game (“Game”).
The Promo Code TOU explain how the User can use a Promo Code obtained by purchasing a Game.
Promo Code Validity – Description of the Offer
Purchasing a Game gives the User access to a promotional code (“Promo Code”) inside the last page of the Rules of the Game booklet or in a separate leaflet.
The Promo Code is a single-use code: the User can only activate this code once, but they can activate it whenever they wish. Asmodee Group cannot guarantee that the offer will remain available beyond a reasonable delay, particularly taking into account how technical requirements change over time.
This Promo Code allows the User, if they so choose, to visit the unboxnow website to perform the procedures needed to benefit from the following promotion:
One month of free Premium membership on the BGA website: valued at €4 including tax (four euros all taxes and fees included).
To learn more about the advantages of having a BGA Platform Premium subscription the User is referred to Clause 9 “Premium Subscription” in the Player General Terms of Service at the following address: https://en.boardgamearena.com/legal?section=tos.
The Promo Code, like the Activation Code sent to the User in the context of this operation, is a single-use code that is non-transferable and prohibited from sale. The Promo Code, and the Activation Code, can only be activated by the User for their own personal use.
How does a User claim the promotional offer?
- Visit the website.
A dedicated section in the Rules of the Game booklet invites the User to visit the following website www.unboxnow.com by way of a URL link or by scanning the QR Code in order to initiate the process to claim their promotional offer:
Any User who has visited unboxnow via the URL link https://gift.unboxnow.com/ or by scanning the QR Code and view the website in the language of their preference from among those made available. To claim the promotional offer, the User must enter the Promo Code from their Game into the dedicated field. If the Promo Code is not entered correctly the User will receive an error message.
- Create an Asmodee account or sign in to your account.
If the User does not already have an account they must create an account on AsmoConnect network. When creating this account, the User must agree to the general terms of use of the AsmoConnect website at the following address: https://account.asmodee.net/fr/legal/terms, AsmoConnect privacy policy at the following address: https://account.asmodee.net/fr/legal/privacy, and confirm that they are old enough to create a personal account under national law.
If the User is registering for the first time on AsmoConnect, they will receive an email to validate the new account. If the User does not receive an email, they may request a new confirmation email at this stage. The email address used to create an AsmoConnect network account is where the email will be sent with instructions on how to continue the process to claim their promotional offer.
- Receiving an Activation Code.
The newly registered User on AsmoConnect and users who have already registered an account now receive an email with a new code (“Activation Code”) and a link to a special interface on the BGA website (“BGA Link”). Both the BGA Link and the Activation Code are valid for a limited time of six weeks. The User has six weeks in which they can visit the BGA platform via the BGA Link and perform the final necessary steps on the platform, which are described below. Example: If the user receives their email on July 1, 2021, then they must open the BGA Link, enter their Activation Code, and perform the required steps (described below) before August 12, 2021. If a User does not do this within the six week period they risk the loss of this promotional offer and, consequently, their one month of free Premium membership.
4. Using the Activation Code on BGA.
The User must visit the BGA platform, enter their Activation Code, and follow the instructions given to them by BGA.
By creating an account, registering the subscription and using the BGA platform the User is understood to have fully accepted the terms of use of the BGA platform, which can be found at this address https://boardgamearena.com/legal?section=tosv, as well as the general terms of service at this address https://boardgamearena.com/legal?section=tos, and the privacy policy on cookies at this address: https://boardgamearena.com/legal?section=ppac .
If the User already has a Premium account:
- In the case of a monthly subscription: the User’s next payment will be postponed by one month, to give them one month of access for free. Example: If the User has paid for a monthly Premium membership for the period from July 1 to August 1, 2021, and they enter an Activation Code in July 2021, then their monthly Premium subscription ends on September 1, 2021 (unless they choose to extend it).
- In the case of an annual subscription: the annual membership period will be extended by one month, free of charge. Example: If the User has paid for an annual Premium membership for the period from July 1, 2021 until July 1, 2022, then they enjoy an additional month free: from July 1 until August 1, 2022. The User can cancel their annual membership at any time and their subscription will not auto-renew on July 1, 2022, since they benefit from the one month of Premium membership free of charge.
The User will not be debited the cost of their annual subscription during the first month. At the end of their one month of free access, the Premium account becomes payable. The User receives an email seven days prior to the end of their free month to inform them of their right to cancel their Premium membership and avoid being debited.
The User must refer to the terms of service at the following address: https://en.boardgamearena.com/legal?section=tos on the BGA website to learn about the conditions for cancelling their subscription and the possible cancellation options.
- Owning Several Codes
If the User has more than one Promo Code and, consequently, more than on Activation Code, because they have purchased several Games, then these codes are cumulative under the following conditions:
- The Activation Code obtained by entering a Promo Code on the Unboxnow website cannot be activated on the BGA website for one month free of Premium membership, if the User already has one month free of Premium membership activated.
In fact, if the User has several Promo Codes and connects to the Unboxnow website to activate them concurrently, they will receive a separate Activation Code for each Promo Code they entered, each of which is valid for six weeks starting from the date that the User receives the BGA Link and Activation Code. Once an account has been created on the BGA platform, the User can only enter one Activation Code for one month free of Premium membership at a time. Otherwise, the User will receive an error message on the BGA platform. To use another Activation Code, a User must wait until the end of their one month free before they enter the next Activation Code on the BGA platform.
Example: if a User enters two Promo Codes on the Unboxnow website and as a result obtains two Activation Codes in an email received on July 1, 2021, then the User has six weeks to enter the different Activation Codes i.e. until August 12, 2021. To enjoy the benefits of having two Activation Codes, the User must enter both Activation Codes within this timeframe, but they can only enter the second Activation Code once the first code has expired. To do this, they must enter the first Activation Code on July 1, 2021, for one month free of Premium membership until August 1, 2021. Then they have from August 1 until August 12, 2021 to enter the second Activation Code and benefit from their second month free of Premium membership.
For this reason, we recommend that a User who obtains several Promo Codes by purchasing several Games enter their Activation Code on the BGA platform as soon as they receive the email containing the Activation Code, in order to have enough time to enter the second Activation Code after the one month free of Premium membership has expired.
To make life easier, we recommend that a User who has several codes in their possession should wait until the one month free of Premium membership has expired before they enter another Promo Code on the Unboxnow website.

Liability
Any additional costs incurred to obtain or use a Promo Code are the sole responsibility of the User. Asmodee Group, Asmodee Digital, or BGA cannot be held responsible for any costs incurred whatsoever on the User’s behalf.
• Asmodee’s Liability
Asmodee Group cannot be held responsible for any direct or indirect damages, regardless of the causes, origins, nature or consequences, even if Asmodee Group was warned of the possibility of such damages, which may result from:
a) Failure of the Internet network or the User’s computer equipment (hardware and/or software and/or databases and/or data) or any other problem related to telecommunication networks, resources and services, to computer services (online or offline), servers, broadband access providers and/or Internet hosting services, IT equipment or software, or any kind of databases or data whatsoever;
b) Access by a person to the Asmodee Group website, the AsmoConnect platform, or BGA; or their inability to access the aforementioned websites.
c) Using, or the impossibility of using, the aforementioned websites, including any damage or a computer virus that infects the User’s computer equipment and/or any other type of property.
Asmodee Group cannot be held responsible in the event of an incident and/or accident that occurs while the User is using their Premium subscription on the BGA platform.
Moreover, Asmodee Group’s liability is limited to ensuring that the Promo Code functions correctly in the event that a User cannot activate it themselves on the Unboxnow website, and only after the User has requested help from the Asmodee Group.
• BGA Platform Liability
In the event that a User cannot activate their promotional offer on the BGA website and has requested help from customer services, the liability of the BGA platform is limited to the attribution and use of the Activation Code.

General Provisions
The failure to exercise or enforce any of the terms in these TOU does not constitute a waiver of these rights and terms by Asmodee Group, Asmodee Digital, or BGA.
If contradictions are found to exist in the various terms and conditions, the Promo Code TOU take precedence over those of Unboxnow, AsmoConnect, and the Board Game Arena platform.
This document has been translated into English for your information only. Only the French version will prevail in the event of a dispute. These terms will be executed and interpreted in accordance with French law.
If any of the clauses in these TOU are found to be invalid by any decision of a competent court, they shall be deleted without affecting any of the other clauses in this agreement.
If no amicable solution can be reached, the User may request an amicable mediation solution within a maximum period of one year, starting from the date that a written complaint is made to Asmodee Group:
- by referring the matter to a consumer mediator with a view to amicably resolving the dispute. To this end, the dispute shall be submitted to mediation in accordance with the mediation rules of the CMAP – Centre de médiation et d’arbitrage de Paris [mediation and arbitration center of Paris] – at the Chambre de commerce et d’industrie de Paris Ile-de-France [the Paris Ile-de-France chamber of commerce],
- or by using the online dispute resolution system of the European Union, which you will find here. The European Commission will transfer your claim to the competent national mediator.
If the User is a French resident, then by default the competent court will be the Tribunal Judiciaire de Versailles or if the User wishes, the jurisdiction of their residence at the time this agreement was made, unless there are several defendants or involvement of a third party.
